SUMMARY:Unconscious Bias In the Workplace: Strategies to Avoid Unwittingly Marginalizing Employees
DESCRIPTION:All human beings have biases (both positive and negative). They are mental “shortcuts” we use that may or may not reflect something true about the person(s) with whom we are interacting. We draw inferences from our own lives and experiences that we then unconsciously assume are true in all situations. These assumptions can lead to improper stereotyping and marginalization of individuals. \nFor example\, one might assume that because someone is: \n\nyoung\, they must be fluent with technology; or\nof Latin American descent\, they must know how to speak Spanish.\n\nUnconscious bias in the workplace not only harms the workplace culture & productivity\, but can potentially create costly liability for the organization. \nThis seminar looks at the impact of unconscious bias in the workplace and provides solutions for managers to avoid unwittingly marginalizing employees. \n  \nPresented by: Nicholas J. SUMMARY:Performance Appraisals Done Right
DESCRIPTION:Employee performance appraisals are all too often a lost opportunity. Done right\, in a thoughtful and straightforward manner\, they serve as a linchpin of effective communication and employee feedback. It also identifies the potential legal pitfalls associated with them. \nSubtopics Include: \n\n“Management by Objectives”\nmaking performance evaluation a way of life in your organization\nimplementing effective performance and development systems\nhow to conduct an effective employee appraisal interview\nhow to manage a “non-performer”\n\nPresented by: Nicholas J. SUMMARY:What You May Not Know About Employee Documentation
DESCRIPTION:Managers and supervisors are all too familiar with the human resources mantra of “document\, document\, document”. It is almost as if simply writing down seemingly important aspects of workplace issues is in itself a solution to the challenges of legal compliance and leadership. Too often\, however\, workplace documentation creates an additional problem for employment counsel to overcome in court or during an administrative investigation. This back-to-basics workshop is a review of what you may not know about documentation – what it actually is\, how it is used\, and the five deadly mistakes managers and supervisors make time and time again. \nWho should attend? \n\nOwners\nTop managers\nHuman resources staff\nTrainers and others associated with the development of strategies for managing people in your organization\n\nPresented by: Nicholas J. SUMMARY:U.S. Department of Labor’s Payroll Audit Independent Determination Program (“PAID”)
DESCRIPTION:The Wage and Hour Division (“WHD”) of the United States Department of Labor has established a new nationwide pilot program called PAID. The PAID program facilitates resolution of potential overtime and minimum wage violations under the Fair Labor Standards Act (“FLSA”). The program’s primary objectives are to resolve such claims expeditiously and without litigation\, to improve employers’ compliance with overtime and minimum wage obligations\, and to ensure that more employees receive the back wages they are owed—faster. Under the PAID program\, employers are encouraged to conduct audits and\, if they discover overtime or minimum wage violations\, to self-report those violations. Employers may then work in good faith with WHD to correct their mistakes and to quickly provide 100% of the back wages due to their affected employees. \nThis seminar will cover: \n\nWhat is the PAID program?\nHow does the PAID program work?\nWhat does it mean to participate in the PAID Program?\nPAID Program Eligibility Requirements\nReview of General FLSA requirements\nHow to conduct a self-audit?\nHow to handle potential payments?\nPaid Resources\n\nPresented by: Michael J. Sciotti\, Esq. and Ross M. Greenky\, Esq. of Barclay Damon LLP \n  \nLunch served 11:30-12:00.\n Presentation begins at 12:00. \n

SUMMARY:Workplace Harassment: Practical Strategies for a Changing Climate
DESCRIPTION:Workplace harassment claims often blind-side employers. They are high-risk\, expensive and perhaps the most difficult to defend of all employment related lawsuits. Particularly frustrating for an employer is that despite repeated attempts at educating their workforces about policies and legal requirements\, something is getting lost in the translation. Even workers that have undergone harassment training many times cannot seem to apply the rules to their everyday work lives. The result is unacceptable workplace conduct\, lawsuits\, and significant liability exposure. \nThis seminar will address this “lost in translation” frustration for employers. The experienced employment attorneys of Ferrara Fiorenza PC present a unique and innovative perspective on this topic\, along with practical and meaningful harassment law compliance strategies. \nTopics include: \n\nThe challenging and ever-changing nature of harassment law\nA practical and useful explanation of harassment\nBest practices in this new climate\n\nWho should attend? \n\nOwners\nTop managers\nHuman resources staff\nTrainers and others associated with the development of strategies for managing people in your organization\n\nPresented by: Nicholas J. Fiorenza of Ferrara Fiorenza PC \nLunch served 11:30-12:00.\nPresentation begins at 12:00. \n  \n\n \nPowered by Eventbrite

SUMMARY:Social Media In Today's Workplace
DESCRIPTION:The impact of social media in the workplace has quietly gained significance over time. Despite the expanding use of all types of social media by both employers and employees\, very few employers have thought through a practical strategy for addressing this bridge between the workplace and “everyday life”. Issues ranging from supervisors “friending” subordinate employees to employees criticizing—or even insulting—their managers through social media\, can create a minefield for employers. \nThis seminar offers a foundation for employers to: \n\nconsider the legal consequences for improperly addressing social media issues\, and\nproperly leverage the opportunities for social media as a powerful communication tool.\n\nPresented by: Nicholas J. SUMMARY:Is It Time To Scrap Your Employee Handbook?
DESCRIPTION:Too many employers spend hours putting together their company handbook without first undertaking a thoughtful analysis of the handbook’s objectives\, possible unintended consequences\, or even what is actually required to be in the book. This approach can be a formula for poor morale and expensive\, time consuming law suits. The decision to have an employee handbook must carry with it the commitment to having it “done right”. A properly drafted employee handbook can be the cornerstone of positive human relations and pro-active legal compliance. \nThis seminar offers a unique “reset” on the issue and explores the pros and cons of having a company handbook as well as an essential review of policies which should be considered and\, perhaps more importantly\, avoided. \nQuestions explored include: \n\nDetermining your company’s objectives – why do we have a handbook?\nAre there policies my company must have in writing?\nHow do we best address the new Paid Family Leave law\, FMLA\, disability and workers compensation?\nWhat are the top 10 policies we must get right?\nWhen will my current handbook do more harm than good?\n\nPresented by: Nicholas J. SUMMARY:Leave Management: Preparing for NYS Paid Family Leave in 2018
DESCRIPTION:New York State’s Paid Family Leave (PFL) program is fast approaching (1/1/18). While the cost of the program is funded completely by employees\, it will mean new compliance and leave management responsibilities for employers. \nFor employers who are not currently subject to FMLA\, the necessary leave tracking and management will be a new responsibility; but\, even for employers who are already subject to FMLA\, this legislation will likely add a new layer of complexity to it all. \nThis seminar will cover the ins and outs of PFL from an absence and leave management perspective. Topics will include: \n\nWhat is Paid Family Leave (PFL)\nPFL vs Paid Sick Leave\nEmployee Eligibility\nFMLA vs PFL\nNY PFL and DBL Benefits\nEmployee Reinstatement Rights\nWhat Employers Should Do To Prepare\n\nLunch will be served from 11:30-12:00.\n \nPresentation begins at 12:00. \n  \n\n \nPowered by Eventbrite

SUMMARY:NYS Paid Family Leave: How Employers Can Prepare for 2018
DESCRIPTION:We will be hosting a half-day seminar to cover the ins and outs of New York’s new Paid Family Leave regulations. \nWe will also be live-streaming this seminar for those who are unable to join us onsite (New Hartford\, NY). \n  \nEffective January 1\, 2018\, ALL private employers (even those who are not subject to FMLA) with employees domiciled in New York State will be mandated to provide Paid Family Leave (PFL) benefits to both full-time and part-time employees. While this legislation has similarities to federal FMLA\, there are many differences. It’s important that you understand the legislation and what it means for you\, as an employer. \nNOTE: because more details are now available\, this seminar will provide significantly MORE information than what was included in our webinar on this topic back in April. If you joined us in April\, you should still consider attending this new session. \nThis seminar will review the following topics: \n\nWhat employers fall under the law?\nWhat are the ‘new’ benefits for employees?\nWho bears the cost?\nWhat will the cost be?\nHow does this tie to NYS Disability benefits and coverage?\nTo FMLA for eligible employers?\nHow does it impact an employer’s vacation\, sick or paid time off policies?\nWhat are the impacts to an employer beyond the cost of the program?\nSample claim scenarios\nMaternity and paternity—what changes?\nSample communication materials employers can use with employees\n\n  \nPresented by Michael J. Sciotti\, Esq. (Barclay Damon LLP) \nBreakfast 8:00- 8:30 \nSeminar 8:30 – Noon \n  \n \nWe will also be live-streaming this seminar! Register here. \n
